How McCarthy's AI collects, uses, and protects your information

This Privacy Policy explains how McCarthy’s AI handles your personal information. We are committed to protecting your privacy and to handling your personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable privacy laws. Please read this policy carefully.

1. Scope of This Policy

1.1  This policy applies to personal information we collect through the McCarthy’s AI platform (the “Platform”), our website, and related communications, whether you are a Sponsor, a Participant, or another visitor.

1.2  This policy does not cover the privacy practices of third parties, including Sponsors who receive your information through the Platform. Once a Sponsor lawfully receives your information, the Sponsor handles it under its own privacy practices and its obligations to us. See Section 9.

2. Who We Are and How to Contact Us

2.1  The Platform is operated by Verta Ventures Inc., a corporation existing under the laws of Ontario, Canada, with its registered address at 80 Mill Street, No. 1209, Toronto, Ontario, M5A 4T3, Canada (“McCarthy’s”, “we”, “us”, or “our”).

2.2  We have designated a person accountable for our compliance with this policy and with privacy law. You can reach our privacy contact at support@mccarthys.ai, or by mail at the address above, marked to the attention of “Privacy”.

3. Information We Collect

We collect the following categories of personal information:

3.1 Information you provide when you register and use your Account

  • Name;
  • Email address;
  • Mobile or phone number;
  • Location (such as country, region, or city);
  • Time zone;
  • Education history;
  • Work history;
  • Professional certifications;
  • Any other profile information you choose to provide.

3.2 Information related to Competitions

  • Your applications to, and participation in, Competitions;
  • Your Submissions and associated metadata;
  • Communications you send through the Platform.

3.3 Information collected if you win a prize

  • Government-issued identification information, for identity verification;
  • Payment details necessary to send your prize (for example, the information required by our payment processor);
  • Tax-related information required by law (for example, a Social Insurance Number for Canadian tax reporting, or a tax form such as Form W-8BEN or Form W-9 for non-Canadian or U.S. winners).

3.4 Information for Sponsors

  • Business contact details, including the name, title, and corporate email of the authorized signatory;
  • Information used to verify the Sponsor (such as corporate registration details and sanctions-screening results);
  • Billing and payment information.

3.5 Information we collect automatically

  • Device and browser information;
  • IP address;
  • Usage data, such as pages viewed, features used, and timestamps;
  • Information collected through cookies and similar technologies (see Section 7).

 

3.6  Sensitive information. We do not seek to collect sensitive information beyond what is described in this policy. Please do not provide sensitive information (such as health information) unless we specifically request it for a stated purpose.

4. How We Collect Information

4.1  Directly from you, when you register, complete your profile, apply to or participate in Competitions, submit work, claim a prize, or contact us.

4.2  Automatically, when you use the Platform, through cookies and analytics as described in Section 7.

4.3  From third parties, in limited circumstances, such as our payment processor (confirmation that a payment succeeded), public corporate registries and sanctions lists (for Sponsor verification), and service providers that help us operate the Platform.

5. Why We Collect and Use Your Information

We collect and use personal information for the following purposes:

  • To create and manage your Account;
  • To operate Competitions, including processing applications, accepting Submissions, and enabling judging;
  • To verify identity and eligibility, and to prevent fraud, cheating, and abuse;
  • To verify Sponsors and screen against applicable sanctions lists;
  • To pay prizes to Winners and to meet related tax and reporting obligations;
  • To enable Sponsors to evaluate Participants and to provide Sponsors with the exports described in Section 9;
  • To communicate with you about your Account, Competitions, and prizes (transactional communications);
  • To send you marketing communications where you have given consent (see Section 14);
  • To analyze and improve the Platform;
  • To comply with legal obligations and to protect our legal rights;
  • For other purposes for which we obtain your consent.

6. Consent

6.1  By using the Platform and providing your information, you consent to our collection, use, and disclosure of your personal information as described in this policy. For certain uses, such as marketing communications, we ask for your express consent separately.

6.2  Withdrawing consent. You may withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice, by contacting us at support@mccarthys.ai. Withdrawing consent may mean we can no longer provide certain features, and it does not affect processing already carried out, information we are required to retain by law, or obligations under the Submission Terms in respect of work you have already submitted.

7. Cookies and Analytics

7.1  Cookies. We use cookies and similar technologies to operate the Platform, remember your preferences, keep you signed in, and understand how the Platform is used. Some cookies are necessary for the Platform to function; others help us analyze usage.

7.2  Analytics. We use Google Analytics to understand how visitors use the Platform. Google Analytics collects information such as your IP address, device and browser information, and usage activity, and processes it on our behalf. You can learn about Google’s practices and opt-out options at the locations Google makes available, including the Google Analytics opt-out browser add-on.

7.3  Managing cookies. Most browsers let you refuse or delete cookies through their settings. If you disable certain cookies, some features of the Platform may not work properly.

8. How We Share Your Information

We share personal information only as described below:

8.1 With Sponsors

When you join a Sponsor’s Competition, we share your profile information and Submission with that Sponsor so the Sponsor can run and judge the Competition. After the Competition, the Sponsor may export this information for the limited purposes described in Section 9. We do not share your information with a Sponsor whose Competition you did not join.

8.2 With service providers

We share information with third parties that help us operate the Platform, such as our hosting provider, our analytics provider (Google), and our payment providers (Wise, for prize payouts, and a payment processor for Sponsor billing). These providers are permitted to use your information only to provide services to us.

8.3 For legal and safety reasons

We may disclose information where we believe it is necessary to comply with a law, regulation, legal process, or governmental request; to enforce our agreements; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of McCarthy’s, our Users, or the public.

8.4 In a business transfer

If McCarthy’s is involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction, subject to this policy or a successor policy.

 

8.5  No sale of personal information. We do not sell your personal information.

9. Sponsors as Independent Recipients of Your Information

9.1  What Sponsors receive. After a Competition, the Sponsor may export the profile information and Submission of Participants who joined that Competition, including (for Winners) the information needed for lawful follow-up engagement.

9.2  Restrictions on Sponsors. Under our Sponsor Agreement, Sponsors may use your information only to evaluate you in connection with the Competition’s objective, to hire or contract with you, and for internal record-keeping. Sponsors are prohibited from selling your information, using it for unrelated mass marketing, or sharing it with their Sub-Sponsors without additional consent, and they must delete or anonymize exported information within twenty-four (24) months unless a separate engagement with you provides otherwise.

9.3  Sponsors’ own responsibility. Once a Sponsor lawfully receives your information, the Sponsor is responsible for handling it in accordance with applicable law and its obligations to us. If you have concerns about a Sponsor’s handling of your information, you may contact us and we will assist where we can.

10. International Transfers and Where Your Information Is Stored

10.1  Cross-border processing. McCarthy’s is based in Canada. Our service providers, including our hosting, analytics, and payment providers, may store or process information in Canada, the United States, or other countries. As a result, your information may be transferred to, stored in, and processed in countries other than your own.

10.2  Foreign legal access. When information is processed in another country, it is subject to the laws of that country and may be accessible to courts, law enforcement, and authorities in that country under applicable law.

10.3  Safeguards. We take reasonable steps to require our service providers to protect personal information with safeguards comparable to those we apply, regardless of where the information is processed.

11. How Long We Keep Your Information

11.1  Retention. We keep personal information only for as long as reasonably necessary for the purposes described in this policy, to operate the Platform, to comply with our legal, tax, and accounting obligations, to resolve disputes, and to enforce our agreements.

11.2  Submissions. Submissions, and information about Submissions, may be retained indefinitely because intellectual property in Submissions is assigned to McCarthy’s under the Submission Terms and may be used by McCarthy’s as described in those terms.

11.3  Tax records. Prize-related tax records are retained as long as required by applicable tax law.

11.4  Deletion. When information is no longer required and we are not legally required to keep it, we will delete or anonymize it using reasonable measures.

12. How We Protect Your Information

12.1  Security measures. We use administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorized access, use, disclosure, or modification, appropriate to the sensitivity of the information.

12.2  No absolute guarantee. No method of transmission or storage is completely secure. While we work to protect your information, we cannot guarantee absolute security.

12.3  Your role. You are responsible for keeping your login credentials confidential and for using a strong, unique password.

13. Your Privacy Rights

Subject to applicable law, you have the following rights regarding your personal information:

  • Access: you may request access to the personal information we hold about you;
  • Correction: you may request that we correct inaccurate or incomplete information;
  • Withdrawal of consent: you may withdraw consent as described in Section 6, subject to legal and contractual limits;
  • Deletion: you may request that we delete your personal information, subject to information we are required or permitted to retain (including Submissions and tax records);
  • Complaint: you may make a complaint as described in Section 19.

 

13.1  How to exercise your rights. To exercise any of these rights, contact us at support@mccarthys.ai. We may need to verify your identity before responding. We will respond within the time required by applicable law. There is generally no charge, though we may charge a reasonable fee where permitted for certain requests.

14. Marketing Communications

14.1  Consent-based marketing. We send commercial electronic messages, such as newsletters and announcements about new Competitions, only to recipients who have given express consent, in accordance with Canada’s Anti-Spam Legislation (CASL). At sign-up, marketing consent is requested separately and is optional; you can use the Platform without consenting to marketing.

14.2  Unsubscribing. You can withdraw marketing consent at any time by using the unsubscribe link in our marketing messages or by contacting support@mccarthys.ai. Even if you unsubscribe from marketing, we will still send you transactional messages necessary to operate your Account and Competitions.

15. Children

15.1  The Platform is intended only for individuals who are at least eighteen (18) years old. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from a person under 18, we will delete it. If you believe a person under 18 has provided us with personal information, please contact us at support@mccarthys.ai.

16. Geographic Availability

16.1  At this time, the Platform is not offered to residents of Quebec, Canada. We may expand availability in the future, at which point we will update our practices and this policy as required by applicable law.

17. Third-Party Links

17.1  The Platform may contain links to third-party websites and services. This policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you use.

18. Changes to This Policy

18.1  We may update this policy from time to time. If we make material changes, we will provide notice through the Platform or by email where appropriate. Changes take effect when posted unless stated otherwise. Your continued use of the Platform after changes take effect constitutes acceptance of the updated policy.
