Terms of Service
Last updated October 28, 2026
These terms apply when you use mccarthys.ai. Please read them carefully, because using the site means you accept them. Our services are provided under separate written agreements, as Section 2 explains.
1. Who we are
McCarthy's AI is operated by Verta Ventures Inc., a corporation existing under the laws of Ontario, Canada, with its registered address at 80 Mill Street, No. 1209, Toronto, Ontario, M5A 4T3, Canada ("McCarthy's", "we", "us" or "our").
These terms form an agreement between you and McCarthy's. If you use the site for a company, you confirm that you can accept them for that company.
2. Our services
We provide AI consulting, AI audits, training, custom AI builds, white-label AI services and data partnerships. Each engagement runs under a written proposal, statement of work or agreement that sets its scope, fees, timing and the ownership of the work.
If that written agreement and these terms differ, the written agreement controls for that engagement.
3. Using the site
You can use the site to learn about our services and get in touch with us. You agree that you won't:
- break any law or anyone else's rights;
- try to reach systems or data you aren't allowed to reach;
- disrupt or overload the site, or spread malicious code;
- copy the site's content at scale with bots or scrapers, or use it to train AI models, without our written permission;
- pretend to be McCarthy's or to be connected to us.
4. Information on the site
The site gives general information. Our insight articles summarize research and public sources as of their dates. They don't give legal, financial, tax or other professional advice for your situation.
The AI readiness check gives a starting estimate from your answers. Prices, time frames and savings on the site are estimates too. Only a signed proposal sets the actual price and scope of work.
Figures for data partnerships, such as deal sizes and payment times, are indicative ranges from our data partners. A deal's terms are set only in an agreement your business signs.
5. Case studies and reviews
Our case studies describe real work, shared with our clients' permission. We describe clients by their industry to keep them private. Reviews come from real clients. Results depend on each business, so yours may be different.
6. Intellectual property
McCarthy's or its licensors own the site and its content, including text, graphics, logos and code. You may view the site, share links to it and print pages for your own use. Any other use needs our written permission.
Each client's agreement sets who owns the work we do for that client. Other companies' names and logos on the site belong to their owners.
7. Other services and links
The site links to other services, such as our scheduling tool, YouTube and our social media pages. Their own terms and privacy policies apply, and we aren't responsible for them.
8. Disclaimers
The site is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the site will always be available, error-free or secure.
9. Limitation of liability
To the extent the law allows, McCarthy's isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, that arise from your use of the site.
To the extent the law allows, our total liability for any claim about the site is limited to one hundred Canadian dollars (CAD $100). Each client's written agreement sets our liability for our services.
Nothing in these terms limits rights that consumer protection laws give you and that can't be limited by contract.
10. Indemnity
If you use the site in breach of these terms, you agree to cover the losses and reasonable legal costs your breach causes us.
11. Privacy
Our Privacy Policy explains how we handle personal information.
12. Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules.
Before you start a formal proceeding, contact support@mccarthys.ai and try in good faith to resolve the dispute with us for at least 30 days. After that, the courts in Toronto, Ontario have jurisdiction, and you consent to them.
Either side may still ask a court for urgent relief to protect intellectual property or confidential information.
13. Changes to these terms
We may update these terms. The date at the top shows the latest version. Changes apply from the time we post them, and they don't change engagements already under a signed agreement.
14. General
These terms and our Privacy Policy are the whole agreement between you and us about the site. If a court finds part of these terms unenforceable, the rest still applies. If we don't enforce a term right away, we can still enforce it later. You may not transfer these terms to anyone else. We may transfer them as part of a business transfer.
